These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CamGig ("Company," "we," "our," or "us"). By accessing or using our website, applications, platforms, or services (collectively, the "Services"), you agree to comply with and be bound by these Terms.

CamGig processes personal data in accordance with its Privacy Policy which explains how we collect, use, store, and share user information. The Privacy Policy forms part of these Terms.

1. Eligibility and Account Registration

1.1 Eligibility

You must be at least 18 years old to access or use CamGig's Services. By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a legally binding agreement.

If you do not meet this requirement, you are not permitted to access or use the Services.

We may implement age verification measures to enforce this requirement and reserve the right to suspend or terminate any account that violates this provision.

1.2 Account Registration

To access certain features of the Services, you may be required to create an account.

You agree to:

  • Provide accurate, complete, and up-to-date information during registration
  • Maintain and promptly update your information to keep it accurate and current
  • Not create an account using false or misleading information
  • Not impersonate any individual or entity or create an account on behalf of another person without proper authorization

1.3 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account.

You agree to:

  • Keep your login credentials secure
  • Notify us immediately of any unauthorized access, use, or security breach

CamGig shall not be liable for any loss, damage, or unauthorized activity resulting from your failure to safeguard your account credentials.

2. Use of Services

2.1 Lawful Use

You agree to use the Services only for lawful purposes and in compliance with these Terms and all applicable laws and regulations.

You may not use the Services in any manner that:

  • Harms, disrupts, or impairs the functionality of the platform
  • Interferes with other users' access or use of the Services
  • Violates any applicable law, regulation, or third-party rights

2.2 Platform Role (No Employment Relationship)

CamGig is a technology platform that connects businesses ("Employers") with individuals seeking gig or employment opportunities ("Job Seekers").

CamGig does not:

  • Employ Job Seekers or act as an employer of any user
  • Act as a recruitment agency, staffing agency, or labor provider
  • Control, supervise, or direct any work performed by Job Seekers

All agreements, engagements, and working relationships are solely between Employers and Job Seekers.

Users are solely responsible for evaluating opportunities, candidates, working arrangements, and any agreements they enter into.

CamGig does not control, verify, or guarantee the identity, qualifications, background, experience, conduct, or suitability of any user.

During the current phase of the platform, CamGig does not facilitate, process, hold, collect, or enforce payments between Employers and Job Seekers.

2.3 Gig (Shift-Based Work) Model

For short-term or gig-based work opportunities:

Employers may publish shift-based opportunities that include information such as job duties, required qualifications, schedules, work locations, and expected compensation.

During the current phase of the platform, CamGig does not process or facilitate payments related to gig work.

Any compensation arrangements, payment terms, or financial agreements are made directly between Employers and Job Seekers outside of the Services.

CamGig only provides technology tools to support job discovery, matching, and communication between users. CamGig is not involved in:

  • Negotiating compensation or payment terms
  • Processing or transferring payments
  • Guaranteeing payment completion
  • Resolving payment disputes between users

Any disputes, payment issues, cancellations, or follow-up arrangements related to gig work must be handled directly between the Employer and Job Seeker.

Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between CamGig and any user.

2.4 Long-Term Job Recruitment Model

For full-time or part-time employment opportunities:

Employers may use CamGig to publish job opportunities, access hiring tools, and connect with potential candidates.

During the current phase of the platform, these features are provided without subscription fees or pay-per-hire charges.

CamGig acts solely as a technology platform that facilitates job discovery and communication between Employers and Job Seekers.

CamGig does not:

  • Make hiring decisions
  • Select candidates on behalf of Employers
  • Guarantee successful recruitment outcomes
  • Participate in employment negotiations between users

Employers are solely responsible for evaluating candidates, conducting interviews, verifying information, and making hiring decisions.

Job Seekers are solely responsible for evaluating job opportunities and determining whether an opportunity is suitable for their skills, circumstances, and expectations.

2.5 User Responsibilities

2.5.1 Job Seeker Responsibilities

Job Seekers are responsible for ensuring that all information provided through the Services is accurate, complete, and up to date.

Job Seekers must provide truthful information regarding their:

  • Profile information
  • Qualifications, skills, and experience
  • Availability and scheduling preferences
  • Payment or income-related information where applicable

When accepting an opportunity, Job Seekers are responsible for:

  • Attending accepted shifts or work commitments on time
  • Performing agreed tasks professionally and according to agreed requirements
  • Following reasonable workplace rules, safety procedures, and instructions provided by Employers
  • Promptly notifying Employers or CamGig if they cannot attend, complete, or fulfill an accepted commitment

Job Seekers are responsible for complying with applicable legal obligations related to payments or income received through opportunities found on the platform, including applicable tax, labor, or reporting requirements.

2.5.2 Employer Responsibilities

Employers are solely responsible for all job and gig opportunities they create, publish, or communicate through the Services.

Employers must ensure that all job and gig postings are:

  • Accurate, complete, and not misleading
  • Lawful and compliant with applicable laws and regulations
  • Non-discriminatory and based on legitimate job-related requirements
  • Safe and reasonably suitable for the work being offered

Before a Job Seeker accepts an opportunity, Employers must clearly disclose all material conditions, including where applicable:

  • Compensation or payment arrangements
  • Working hours, shift schedules, and expected duration
  • Work location or remote work requirements
  • Job duties, responsibilities, and expectations
  • Required qualifications, skills, or experience
  • Cancellation, replacement, or termination conditions
  • Any other conditions that may reasonably affect a Job Seeker's decision

Employers are responsible for complying with all applicable legal obligations, including but not limited to:

  • Labor and employment laws
  • Tax obligations
  • Workplace health and safety requirements
  • Immigration requirements
  • Social security or mandatory benefit obligations

Employers remain solely responsible for their workplace conditions, employment decisions, business operations, and relationships with Job Seekers.

2.6 No Guarantee of Availability, Matching, or Outcomes

CamGig provides a platform that enables Employers and Job Seekers to connect; however, CamGig does not guarantee any specific outcome from the use of the Services.

CamGig does not guarantee that:

  • Employers will find suitable Job Seekers
  • Job Seekers will find suitable job or gig opportunities
  • Any user will receive applications, offers, interviews, engagements, or employment
  • Any Employer and Job Seeker will successfully establish a working relationship
  • Any work arrangement will be completed successfully
  • Any compensation or payment will be made, received, or completed between users

CamGig does not guarantee or assume responsibility for:

  • The accuracy or completeness of user-provided information
  • The quality, legality, safety, or suitability of any opportunity
  • The conduct, reliability, qualifications, or performance of any user
  • Any disputes, losses, damages, or claims arising from relationships between users

Users are responsible for conducting their own evaluations, exercising appropriate judgment, and taking reasonable precautions before entering into any work arrangement through the Services.

3. Prohibited Activities

You agree that you will not, directly or indirectly, engage in any of the following activities while using the Services:

  • Legal Violations: Use the Services in any manner that violates any applicable local, national, or international laws, regulations, or legal obligations.
  • Fraud & Misrepresentation: Provide false, inaccurate, or misleading information, including but not limited to misrepresenting your identity, qualifications, experience, services, or job details. This includes posting fake job listings, fraudulent opportunities, or engaging in deceptive practices.
  • Unauthorized Access: Attempt to gain unauthorized access to any portion of the Services, other user accounts, computer systems, or networks connected to the platform, whether through hacking, password mining, or any other means.
  • Malicious Activity: Upload, transmit, distribute, or otherwise introduce any viruses, malware, spyware, or other harmful or destructive code that may damage, disrupt, or limit the functionality of the Services or any related systems.
  • Platform Abuse: Interfere with, disrupt, or compromise the integrity, security, or performance of the Services. This includes attempting to bypass system safeguards, rate limits, security features, or protective mechanisms.
  • Circumvention of Platform: You may not use the Services to facilitate fraudulent, deceptive, or harmful transactions. While payments may occur outside the platform during the POC phase, users must not misuse the platform to conduct scams, fraud, or illegal financial activities.
  • Scams and Harmful Conduct: Engage in scams, harassment, threats, abusive behavior, or any conduct that is harmful, exploitative, or otherwise negatively impacts other users or the platform.
  • Objectionable Content: Post, upload, share, or distribute any content that is unlawful, harmful, abusive, defamatory, obscene, offensive, or otherwise objectionable, as determined by CamGig in its sole discretion.

4. Community Standards

CamGig is committed to maintaining a safe, respectful, and professional environment for all users. By using the Services, you agree to adhere to the following standards of conduct:

4.1 Professional Conduct

You agree to:

  • Treat all users with respect, fairness, and professionalism
  • Communicate honestly and courteously in all interactions
  • Provide accurate, truthful, and reliable information at all times
  • Respect the privacy, confidentiality, and personal data of others

4.2 Prohibited Behavior

You must not engage in:

  • Harassment, intimidation, threats, or abusive conduct
  • Discrimination based on race, gender, religion, nationality, disability, or any other protected characteristic
  • Hate speech or content that promotes violence or harm against individuals or groups
  • Any conduct that is harmful, exploitative, or unsafe to others

4.3 Prohibited Content

You may not post, upload, or share content that includes, but is not limited to:

  • Violence, threats, or graphic content
  • Exploitative, abusive, or harmful material
  • Illegal products or services (including but not limited to drugs, human trafficking, or weapons)
  • Spam, scams, misleading information, or deceptive offers
  • Content that infringes on intellectual property or privacy rights

4.4 Enforcement

Violations of this Section may result in actions taken by CamGig at its sole discretion, including but not limited to:

  • Removal of content
  • Temporary suspension of account access
  • Permanent account termination
  • Restriction of platform features
  • Reporting to law enforcement where required

5. Software and Platform Access

Our Services may include mobile applications, web applications, or other software that may update automatically to improve performance, security, and functionality.

You agree that you will not:

  • Copy, modify, distribute, sell, license, or lease any part of the Services
  • Reverse engineer, decompile, disassemble, or attempt to extract source code
  • Interfere with or disable security features or system protections
  • Use the Services in any way that is not intended or authorized by CamGig

We grant you a limited, non-exclusive, non-transferable license to use the Services solely for lawful and permitted purposes under these Terms.

6. User Content

You retain ownership of any content you submit, upload, or create on the platform ("User Content").

6.1 License to CamGig

By using the Services, you grant CamGig a worldwide, non-exclusive, royalty-free license to:

  • Store, host, and process your content
  • Display and distribute your content within the platform
  • Use your content to operate, improve, and promote the Services
  • Use content for safety, moderation, fraud prevention, and platform integrity

6.2 Responsibility for Content

You are solely responsible for your User Content. You agree that your content will not:

  • Violate any applicable laws or regulations
  • Infringe the rights of any third party
  • Contain false, misleading, or fraudulent information (including fake jobs or fake profiles)

We do not endorse or guarantee the accuracy, reliability, or legality of any User Content posted by users.

7. Platform Enforcement

We reserve the right, but are not obligated, to monitor activity on the platform to ensure compliance with these Terms, protect users, and maintain platform integrity.

We may investigate suspected violations and take appropriate action at our sole discretion, including:

  • Removing or restricting access to content
  • Suspending or permanently terminating user accounts
  • Restricting accounts, removing content, or suspending access in cases of fraud, disputes, or policy violations

Such actions may be taken without prior notice where necessary to:

  • Protect users or the platform
  • Prevent fraud or abuse
  • Comply with legal obligations or government requests

8. Suspension and Termination

8.1 Suspension and Termination by Us

We reserve the right, at our sole discretion, to suspend, restrict, or terminate your account and access to the Services at any time, with or without prior notice, and without liability, for any reason, including but not limited to:

  • Violation of these Terms or any applicable policies
  • Suspected fraud, abuse, or illegal activity
  • Requests or requirements by law enforcement or regulatory authorities
  • Risks posed to the platform, other users, or third parties

We may also suspend or terminate accounts that remain inactive for an extended period (e.g., more than twelve (12) months), particularly where no active subscription or paid service is maintained.

8.2 Effect of Termination

Upon suspension or termination:

  • Your right to access and use the Services will immediately cease
  • Any ongoing engagements between users are outside the platform and remain the responsibility of the users
  • We may retain or delete your data in accordance with our Privacy Policy and legal obligations

All provisions of these Terms that by their nature should survive termination, including but not limited to ownership, disclaimers, limitations of liability, indemnification, and dispute resolution, shall continue in full force and effect.

CamGig is not liable for any loss of opportunities, income, or expected earnings resulting from suspension or termination.

8.3 Appeals and Review

If you believe that your account has been suspended or terminated in error, you may submit an appeal by contacting our Support team at camgig-ml@kdl.co.jp.

We will review appeals in good faith; however, CamGig reserves the right to make the final decision regarding account reinstatement.

9. Discontinuation of Services

We reserve the right to modify, suspend, or discontinue all or part of the Services at any time, temporarily or permanently, with or without prior notice, for operational, business, legal, or security reasons.

Where reasonably possible, we will provide advance notice before any material discontinuation of the Services.

In the event of a permanent discontinuation of paid Services, we will provide a refund for any prepaid and unused portion of eligible Services, unless otherwise required or restricted by law.

You acknowledge that we are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.

10. Anti-Fraud and Compliance

CamGig actively monitors platform activity to help prevent fraud, abuse, and other illegal activities.

We reserve the right to:

  • investigate suspicious activity
  • request additional information or documentation
  • suspend or restrict accounts

Since CamGig does not process or facilitate payments, we do not control, delay, freeze, or cancel any financial transactions between users. However, we may take necessary action on accounts or content where required to comply with applicable laws or regulatory obligations.

Users agree to cooperate fully with any such investigations.

11. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, CamGig makes no representations or warranties of any kind, whether express, implied, or statutory, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or availability of the Services

We do not guarantee that:

  • The Services will be uninterrupted or error-free
  • Job or gig postings will result in successful hiring or engagement
  • Users will perform obligations properly or lawfully

12. Limitation of Liability

12.1 Limitation of Liability

To the maximum extent permitted by applicable law, CamGig, including its affiliates, officers, directors, employees, agents, partners, and service providers, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

  • Loss of profits, revenue, business opportunities, contracts, or expected savings
  • Loss of data, goodwill, reputation, or business relationships
  • Disputes, claims, or disagreements between users, including Employers and Job Seekers
  • Any actions, omissions, misconduct, or failures of users or third parties
  • Any employment, contractual, payment, or service arrangements entered into between users outside the Services

arising out of or related to your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

CamGig's total liability arising out of or relating to your use of the Services shall not exceed USD $100, to the maximum extent permitted by applicable law.

If you pay any fees to CamGig in the future, this limitation may be updated to reflect the applicable service fees paid by you.

12.2 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such cases:

  • The above limitations will apply to the maximum extent permitted by applicable law
  • Certain disclaimers or limitations may not apply to you

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

13. Indemnification

You agree to defend (at your expense), indemnify, and hold harmless CamGig, its affiliates, officers, employees, and partners from and against any claims, demands, actions, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • your use of the Services
  • your violation of these Terms
  • any claim by a third party arising from your actions
  • disputes between you and other users
  • any content or information you submit
  • any fraudulent, negligent, or unlawful activity performed by you

14. Force Majeure

CamGig shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from events beyond its reasonable control, including but not limited to:

  • natural disasters
  • war, terrorism, or civil unrest
  • government actions or restrictions
  • power outages or internet disruptions
  • system failures or technical issues

During such events, CamGig's obligations shall be suspended for the duration of the force majeure condition.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Kingdom of Cambodia, without regard to its conflict of law principles.

15.2 Dispute Resolution

  • Informal Resolution: We encourage you to contact us first to resolve any dispute informally. Most issues can be resolved quickly through our support team.
  • Formal Resolution: If a dispute cannot be resolved informally, the parties agree to attempt resolution through good-faith negotiation. Any dispute, controversy, or claim arising out of or relating to these Terms shall be finally resolved by arbitration in the Kingdom of Cambodia. Unless otherwise agreed, arbitration shall be conducted in accordance with the rules of the National Commercial Arbitration Centre (NCAC) of Cambodia. The arbitration shall be conducted in English, and the decision of the arbitrator shall be final and binding on the parties.
  • Court Proceedings: Nothing in this section prevents either party from seeking urgent injunctive or equitable relief from the competent courts of Cambodia to protect intellectual property rights, prevent fraud, or enforce arbitration outcomes.
  • Jurisdiction and Venue: For any disputes not subject to arbitration, the exclusive jurisdiction and venue for legal proceedings will be in the competent courts of the Kingdom of Cambodia, unless otherwise required by applicable law.

16. Changes to Terms

16.1 Updates

We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. Changes may be made to reflect updates in our Services, business model, technology, legal or regulatory requirements, or operational needs.

Where changes are material, we will make reasonable efforts to notify you, which may include:

  • Posting the updated Terms on our website
  • Sending an email to the address associated with your account
  • Displaying a notice within the platform

The "Effective Date" at the top of these Terms will indicate the latest revision date.

You are responsible for reviewing the Terms periodically to stay informed of any updates.

16.2 Continued Use

By continuing to access or use the Services after any updates become effective, you agree to be bound by the revised Terms.

If you do not agree to the updated Terms, you must stop using the Services.

17. Entire Agreement

These Terms, together with the Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and CamGig regarding the use of the Services and supersede all prior or contemporaneous agreements, communications, or understandings, whether written or oral.

18. Future Payment Features

CamGig may introduce payment processing and financial features in the future, including in-platform payments, escrow services, or subscription systems.

When such features are introduced:

  • Additional terms and conditions will apply
  • Users may be required to agree to updated Terms before using such features

Thank you for using CamGig!
